TERMS OF USE AGREEMENT
Your use of this site tells us that you have read and agree to these Terms of Use. These Terms of Use constitute a contract between you and MillionDollarPetPix.com (MDPP), as set forth in these Terms of Use (Terms).
It is our intent to do everything posible to keep this a safe and family-friendly site. If you do not wish to agree to be bound by these Terms, please do not use this site.
MillionDollarPetPix.com may amend or revise these Terms at any time without notice. The amended Terms and Conditions will be effective immediately and you will be bound by the amended Terms and Conditions from that time. It is your responsibility to check this page to review any revised terms.
This Agreement will remain in full force and effect while you use the Website and/or are a Member. You may terminate your membership at any time, for any reason, effective upon receipt by MillionDollarPetPix.com of your written or email notice of termination. MDPP may terminate your membership for any reason, effective upon sending notice to you at the email address you provide in your application for membership, or such other email address as you may later provide to MDPP. If MillionDollarPetPix.com terminates your membership because you have breached the Agreement, you will not be entitled to a refund.
Copyright
You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Without limiting the foregoing, if you believe that your work has been copied and posted on MDPP in a way that constitutes copyright infringement, please provide MDPP with the following information: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the Website; your address, telephone number, and email address; a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
Member Disputes
You are solely responsible for your interactions with other MillionDollarPetPixcom Members (in any future forum we may publish). MDPP reserves the right, but has no obligation, to monitor disputes between you and other Members.
Disclaimers
MillionDollarPetPix.com is not responsible for any incorrect or inaccurate content posted on the website whether caused by users of the website, members or by any of the equipment or programming associated with or utilized in the site. MDPP is not responsible for the conduct, whether online or offline, of any user of the website or member. MDPP assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user or member communications. MDPP is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to users and/or members or to any other person's computer related to or resulting from participating or downloading materials in connection with the Web and/or in connection with MDPP.
Under no circumstances will MDPP be responsible for any loss or damage, including personal injury or death, resulting from anyone's use of the website, any Content posted on the website or transmitted to members, or any interactions between users of the website, whether online or offline. The website is provided "AS-IS" and MDPP expressly disclaims any warranty of fitness for a particular purpose or non-infringement.
MDPP cannot guarantee and does not promise any specific results from use of the website.
Limitation on Liability
Except in jurisdictions where such provisions are restricted, in no event will MDPP be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the website, even if MDPP has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, MDPP liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to MDPP during the term of membership.
Registration
To use the site and be a contributor you must have a registered user name and password. The information you provide about yourself, as prompted by the site registration form must be true, accurate, current and complete (Registration Data). In particular this includes but is not limited to your confirmation either that you are over the age of 13 or that you are the parent or guardian of a person under 13 acting on that person’s behalf and confirming agreement to be a contributor in accordance with these terms. It is also your responsibility to maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, MDPP has the right to suspend or terminate your account and refuse any and all current or future use of the site.
MDPP is very concerned about the safety and privacy of all its users, particularly children under the age of 13. If you are a parent or guardian of a child of any age, it is your responsibility to determine whether any of the services and/or content on the Site are appropriate for your child. For the avoidance of doubt a ‘child’ or a ‘minor’ is a person under the age of 18.
You will create a password and receive a designated account upon completing the registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to:
a) immediately inform MDPP of any unauthorized use of your password or account or any other breach of security, and b) ensure that you exit from your account at the end of each session. MDPP does not accept liability for any loss or damage arising from the failure to comply with the foregoing.
Intellectual Property – Licence and Licence-Back and Terms
By sending photographs to MDPP for posting on this site you confirm that you are the owner of the copyright and any similar right in any such photographs.
By accepting these terms and in consideration of your registration and use of the site you hereby grant MDPP an exclusive licence to use the photographs for all purposes in all media throughout the world for the full period of the copyright and any similar right.
MDPP hereby grants you a non-exclusive licence to use the photographs for private and domestic purposes. If you wish to use the photographs commercially or in any commercial publication please contact us and we will consider an extension of this licence-back in this regard.
Unless otherwise stated, the copyright and other intellectual property rights in all countries in all materials on this site (including without limitation photographs and graphical images) are owned by MDPP or its licensors. Any use of extracts from this site for any purpose is strictly prohibited.
No part of this Site may be reproduced or stored on any other website or included in any public or private retrieval system or service without MillionDollarPetPix.com’s prior written permission.
Service Access
While MDPP endeavours to ensure that the Site is normally available 24 hours a day, MDPP will not be liable if for any reason the Site is unavailable at any time or for any period.
Access to the Site may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond MDPP’s control.
Contribution Rules
Other than personally identifiable information, any material that you transmit or post to this Site will be considered non-confidential and non-proprietary. MDPP will have no obligations with respect to such material. MDPP will be free to copy, disclose, distribute, incorporate and otherwise use such material and all data, images, text and other things embodied therein for any and all commercial and non-commercial purposes.
If you do not wish MDPP to have the rights set out in this paragraph, please do not transmit or post any material or submit any contributions to the site. You acknowledge that you are solely responsible for the content of your submissions and you agree to submit only contributions that are your own original work, such contributions must be accurate (where they state facts) and genuinely held (where they state opinions).
Proper spelling and grammar is your sole responsibility.

MDPP reserves the right at all times, whether or not you are in breach of these Terms, to:

(b) to suspend your access to this Site without further notice to you and MDPP’s decision in these matters shall be final.

The Site is provided “as is” for information purposes only and MDPP gives no warranties of any kind either express or implied in respect thereof. Specifically, but without limitation, MDPP does not warrant that:

(b) this Site or any material of whatsoever nature available on or downloaded from it will be free from viruses or defects, compatible with your equipment or fit for any purpose.

All warranties which would otherwise be implied by law are hereby excluded.

No Warrant
When using this site, you may find many links to 3rd party Internet sites. MillionDollarPetPix.com is not responsible for the content or availability of these 3rd party sites. MillionDollarPetPix.com does not warrant or guarantee the products, services, or information found on external or 3rd party sites.
No Pop-Ups
With the exception of our sole sign-up hover ad, there are no Pop-Ups anywhere within the MillionDollarPetPix.com site. If you receive one as a result of clicking on any of the 3rd party links found within this site -- know that they did not originate from our site.
Internet
The term "Internet" will be defined as "An interconnected system of networks that connects computers around the world via the TCP/IP protocol as it is currently comprised on launch date November 2007.
Million Dollar Pet Pix will keep this site live on the Internet to the best of our capabilities but are not responsible in any way for future changes in this protocol or legislation that may impact our ability to keep this site live.
By advertising on our site, you agree to hold harmless from and against Million Dollar Pet Pix in the event the definition of the Internet changes in the future that may prevent us from keeping this site live for the full 10 years.
